Important scope limitation

MoCRA Ops Kit is a recordkeeping tool, not a law firm, regulatory representative, testing laboratory, or filing service. It does not provide legal advice, determine whether you comply with law, or guarantee an outcome with the FDA or another party.

These Terms govern use of the public website and Shopify app offered under the MoCRA Ops name by an independently operated, unincorporated software service based in Pune, Maharashtra, India (the "Service," "MoCRA Ops Kit," "we," "our," or "us"). By installing, accessing, or using the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms.

1. The Service

The Service provides operational tools that can help merchants:

  • Synchronize supported Shopify product information
  • Record supported Shopify product and variant versions, show before/after changes, and preserve merchant acknowledgement history
  • Organize product labels, safety documents, supplier records, batches, and related files
  • Record internal adverse-event case information and calculate workflow dates
  • Track merchant-entered facility and product-listing status
  • Generate documentation and export packages from merchant-provided records

Features, plan limits, and pricing are shown in the app and on the Shopify App Store listing.

2. What the Service Does Not Do

  • No filings or submissions: the Service does not submit facility registrations, product listings, adverse-event reports, or other material to the FDA.
  • No legal or regulatory advice: dates, checklists, statuses, and templates are operational aids and are not an interpretation of law.
  • No safety verification: we do not test, approve, certify, or independently verify products, ingredients, labels, documents, or merchant-provided public batch information.
  • No compliance guarantee: use of the Service does not establish or guarantee compliance with MoCRA or any other requirement.

3. Merchant Responsibilities

You are responsible for:

  • Determining which laws, exemptions, filing obligations, retention periods, and internal procedures apply to your business
  • Reviewing the accuracy and completeness of synchronized data, merchant-entered records, calculations, and exports
  • Comparing product-change alerts with current labels, safety records, and other source materials; acknowledgement records review activity but does not establish compliance or approve a document
  • Making required submissions through official channels and meeting all applicable deadlines
  • Obtaining appropriate authority, notices, and consents before entering personal or health-related information
  • Restricting app access to authorized staff and protecting your Shopify account
  • Exporting records you need before cancellation or uninstall

4. Accounts and Shopify

Access is authenticated through Shopify. Your use of Shopify remains subject to Shopify's own agreements. You authorize the Service to use the permissions approved during installation for providing app functionality. You must promptly notify us if you believe access has been compromised.

5. Merchant Content

You retain your rights in content and records you provide. You grant us and our service providers a limited right to host, process, transmit, and reproduce that content only as needed to provide, secure, maintain, and support the Service or comply with law. You represent that you have the necessary rights and authority to provide that content.

6. Subscriptions, Trials, and Cancellation

  • Paid plans, trials, renewals, and app charges are presented and approved through Shopify.
  • Current prices, trial length, plan limits, and billing intervals are the amounts displayed by Shopify when you approve a charge.
  • You can manage or cancel the subscription through Shopify. Uninstalling the app ends access but does not replace your responsibility to export records you need.
  • Billing questions and refund requests should be sent to us and will be handled consistently with applicable law and Shopify's billing rules.

7. Acceptable Use

You must not:

  • Use the Service unlawfully, deceptively, or to violate another person's rights
  • Upload malware, attempt unauthorized access, interfere with service operation, or bypass plan limits
  • Use public batch pages to make false verification, certification, approval, or endorsement claims
  • Store information that you are not authorized to collect or process
  • Reverse engineer or copy the Service except where applicable law expressly permits it

8. Privacy and Sensitive Information

Our handling of information is described in the Privacy Policy. Adverse-event narratives and attachments can contain sensitive personal or health-related information. Use data minimization, redact unnecessary details, and obtain professional advice about your own privacy obligations.

Merchants determine why personal information is entered or uploaded and remain responsible for having authority to process it. Where applicable law distinguishes a controller or business from a processor or service provider, MoCRA Ops Kit generally processes merchant-provided records on the merchant's behalf to provide, secure, maintain, and support the Service. Roles can differ for account, security, billing-support, support, abuse-prevention, and legal-compliance data, as described in the Privacy Policy.

9. Availability and Changes

We may maintain, modify, add, or discontinue features and may temporarily restrict access for security, maintenance, or legal reasons. We will use reasonable efforts to avoid material disruption and communicate material changes when appropriate.

10. Suspension and Termination

We may suspend or terminate access for material breach, nonpayment, security risk, unlawful use, or where required by Shopify or law. You may stop using the Service by canceling and uninstalling it. Data handling after uninstall or a verified deletion request is described in the Privacy Policy.

11. Intellectual Property

The Service, excluding merchant content, is owned by us or our licensors and is protected by applicable intellectual property laws. No rights are granted except the limited right to use the Service under these Terms.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, CALCULATIONS, EXPORTS, OR THIRD-PARTY SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR A PARTICULAR REGULATORY PURPOSE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, REGULATORY PENALTIES, OR THE COST OF SUBSTITUTE SERVICES ARISING FROM USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED.

14. Changes to These Terms

We may update these Terms as the Service or legal requirements change. We will update the date above and provide additional notice for material changes when appropriate. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.
